Terms of service and sale

1. Purpose
These terms govern the use of the Portlatch service and the subscription to its paid plans. They are agreed between the publisher of the service, identified in the legal notice, and anyone who creates an account (the "customer").
The customer accepts them by ticking the box provided at sign-up. The date of this acceptance is kept.
2. The service
Portlatch makes a service hosted on the customer's local network reachable from the internet, including behind a router or a provider that does not allow opening a port. The customer reserves a route, and incoming traffic reaches them through a WireGuard tunnel set up by the agent they install on their network.
There are two types of route:
- the port forward: a public IPv4 address and port, for any TCP service;
- the web route: a name, routed to the customer's HTTP or HTTPS service according to the name announced by the browser.
The service is inbound only, over TCP and IPv4. It is neither a VPN nor outbound access to the customer's network. Portlatch never terminates encryption: HTTPS or SSH traffic stays encrypted end to end between the visitor and the customer's machine, and Portlatch neither holds nor manages any certificate. Obtaining and renewing the certificate of their service is the customer's responsibility.
3. Your account
An account belongs to a single person. The service is intended for adults; a minor may only use it with the consent of their legal guardians.
The customer provides a valid email address, which they confirm with a code at sign-up. They keep their credentials confidential and are responsible for everything done from their account. An account opens access to the customer's local network: two-factor authentication, available in My account, is strongly recommended.
4. The agent
The agent is free software, released under the Apache 2.0 license. The customer installs and runs it on their own hardware, at their own risk. The agent can reach any machine its network lets it reach: the customer chooses the targets of their routes and makes sure they have the right to expose them.
The private key of the tunnel is generated by the agent and never leaves the customer's machine.
5. Acceptable use
The customer alone is responsible for the services they expose and the content they serve. They must not use Portlatch for:
- any illegal activity, or any infringement of the rights of others, including serving infringing content;
- phishing, distributing malware or controlling compromised machines;
- sending unsolicited email, or running an open mail relay;
- attacking, scanning or flooding third-party systems;
- getting around the limits of their plan, or disrupting the service and its other users.
Ports 25, 465, 587, the email ports, are blocked on every plan.
6. Reports and suspension
Anyone can report abuse to the dedicated address abuse@portlatch.eu , giving the address, port or name involved, and the time it was seen.
In case of obvious abuse or a well-founded complaint, Portlatch may suspend a route without notice, then informs the customer. A serious or repeated breach may lead to the account being closed, with no refund of the current period.
Portlatch responds to requests from the competent authorities, within the framework provided by law.
7. Plans, quotas and speed
The plans, their limits and their prices are described on the plans page, which is part of these terms. They differ in the number of routes, the choice of name, access to a dedicated IP address, maximum speed and traffic volume.
Traffic volume is a quota counted over a rolling 30 days. The customer is warned at 80% of their quota. Beyond 100%, the speed of their account is reduced to 2 KB/s, until their usage falls back under 90% of the quota.
On the free plan, the name of the route is assigned, under portlatch.com. Advertised speeds are caps, not guarantees: the actual speed also depends on the customer's connection and the visitor's.
8. Availability
Portlatch strives to provide a continuous service, without any availability commitment (SLA) or on-call support. The service may be interrupted for maintenance, in case of an incident, or because of its hosting providers. A public IP address may have to change, in particular if it is attacked or listed on a blocklist.
9. Prices and payment
Prices are in euros. VAT not applicable, art. 293 B of the French tax code: the price shown is the price you pay.
A paid plan is subscribed monthly or yearly. It is paid in advance, at subscription then at each renewal, and renews automatically until it is cancelled. Payment is processed by Stripe; Portlatch never sees the card number. An invoice is issued for each payment.
Portlatch may revise its prices, in particular if the cost of IPv4 addresses rises. The customer is told by email at least 30 days in advance; the new price applies from the following renewal, and the customer may cancel before then.
10. Changing plans
Plans are changed from the dashboard, at any time.
- To a more expensive plan, or another billing period: the change is immediate, and the difference is charged right away, prorated over the time left.
- To a cheaper plan: the change is immediate; unused time is credited, prorated, on the following invoices, with no refund. The customer's routes are suspended, and they reactivate them within the limits of their new plan.
The Dedicated plan assigns a dedicated IP address, subject to an address being available. Leaving this plan voluntarily releases the address at once. If the plan is lost for lack of payment, the address stays reserved for the customer for 7 days, giving them time to come back.
11. Failed payment
If a renewal fails, the payment is retried for 14 days, during which the plan is kept and the customer can update their card. After that, the subscription ends and the account goes back to the free plan.
12. Cancellation and closing
The customer cancels their subscription at any time from the dashboard, in one click. Cancellation takes effect at the end of the paid period, with no refund; the customer may undo it until then. The account then goes back to the free plan.
The customer may also close their account from My account. Closing ends any current subscription, immediately and with no refund, and removes their agents, routes and names. What is kept after closing is described in the privacy policy.
13. Right of withdrawal
A consumer customer has 14 days from subscribing to withdraw, without giving a reason (articles L221-18 and following of the French consumer code).
The service starts as soon as payment is made. Before paying, the customer ticks a box by which they ask for this immediate start and acknowledge that they will lose their right of withdrawal once the service has been fully provided. The time of this consent is kept. If they withdraw anyway within the period, they owe the service provided up to their withdrawal, prorated (article L221-25).
To withdraw, the customer writes to the support address support@portlatch.eu , giving the email address of their account. The refund is made within 14 days, using the payment method used.
14. Liability
Portlatch is bound by an obligation of means. It acts as a technical intermediary: it does not know the content carried by the routes, which it cannot read when encrypted, and is not liable for it.
To the extent permitted by law, Portlatch is not liable for indirect damage, data loss, or the consequences of an interruption of the service. The customer remains responsible for the security of the services they expose: a service published on the internet can be reached by anyone.
Nothing in these terms limits the rights a consumer customer holds under the law.
15. Personal data
The data processed, its purposes and how long it is kept are described in the privacy policy.
16. Intellectual property
The website, the server, the Portlatch brand and logo belong to the publisher. The agent is distributed under the Apache 2.0 license, whose terms prevail for its code.
17. Changes to these terms
Portlatch may change these terms. Any substantial change is announced by email at least 30 days before it takes effect; a customer who refuses it may cancel before that date.
18. Governing law
These terms are governed by French law. A consumer customer keeps the protection of the mandatory provisions of the law of their country of residence, and may bring a claim before the competent court under the legal rules. For a business customer, any dispute falls under the courts of the publisher's registered office.
